# Terms of Service

These Terms of Service (hereinafter referred to as "these Terms") define the conditions for using the smartphone application "9days" (hereinafter referred to as "the App") provided by Ryuichi Aida (hereinafter referred to as "we"). Users (hereinafter referred to as "Users") shall use the App in accordance with these Terms.

# Article 1 (Application)

These Terms shall apply to all relationships regarding the use of the App between Users and us.
We may establish various rules and regulations (hereinafter referred to as "Individual Provisions") regarding the use of the App in addition to these Terms. Regardless of their names, these Individual Provisions shall constitute part of these Terms.
When the provisions of these Terms and the provisions of Individual Provisions differ, the Individual Provisions shall take precedence.

# Article 2 (User Registration)

No special user registration is required to use the App. By downloading and launching the App, you are deemed to have agreed to these Terms.

# Article 3 (Usage Fees)

The App is available for free. However, advertisements will be displayed within the App.

# Article 4 (Prohibited Acts)

Users shall not engage in the following acts when using the App:

Acts that violate laws or public order and morals
Acts related to criminal activities
Acts that infringe upon the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of us, other Users of the App, or third parties
Acts of commercially using information obtained through the App
Acts that may interfere with the operation of our services
Acts of unauthorized access or attempting unauthorized access
Acts of modification, disassembly, decompilation, reverse engineering, etc. of the App
Acts of intentionally exploiting bugs in the App
Acts of unnecessarily repeating identical or similar inquiries
Other acts that we deem inappropriate

# Article 5 (Suspension of App Provision)

We may suspend or interrupt all or part of the provision of the App without prior notice to Users if we determine that any of the following reasons exist:
- When performing maintenance, inspection, or updates of the computer system related to the App
- When provision of the App becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters
- When computers or communication lines stop due to accidents
- When we determine that provision of the App is difficult for other reasons
We shall not be liable for any disadvantages or damages suffered by Users or third parties due to the suspension or interruption of the App provision.

# Article 6 (Copyright)

All copyrights and other intellectual property rights regarding the App and all information related to the App belong to us or rights holders who have granted us the right to use them. Users shall not reproduce, transfer, lend, translate, modify, republish, publicly transmit (including making transmittable), transmit, distribute, publish, or use commercially without authorization.
Users may share screenshots of the App on social media, etc. However, use for the purpose of unfairly lowering the App's evaluation is prohibited.
Permission for Game Streaming/Broadcasting: Users may conduct game streaming, play video distribution, and live streaming of the App on video distribution platforms such as YouTube, Twitch, Niconico Video, etc. We welcome and encourage these activities.
- Broadcasting Guidelines:
  - We recommend including the App name "9days" in the video title or description
  - Use in monetized videos is also permitted

# Article 7 (Disclaimer of Warranties and Exemption)

We do not guarantee, either explicitly or implicitly, that the App is free from defects in fact or law (including defects, errors, bugs, rights infringement, etc. related to safety, reliability, accuracy, completeness, effectiveness, fitness for specific purposes, security, etc.).
We shall not be liable for any damages caused to Users due to the App, except in cases of our intentional or gross negligence.
Even in the cases specified in the proviso of the preceding paragraph, we shall not be liable for any damages arising from special circumstances (including cases where we or Users foresaw or could have foreseen the occurrence of damages) among damages caused to Users due to our negligence (excluding gross negligence) in breach of contract or tort.
We shall not be liable for any transactions, communications, or disputes that occur between Users and other Users or third parties in relation to the App.

# Article 8 (Changes to Service Content)

We may change, add, or discontinue the content of the App with prior notice to Users, and Users agree to this.

# Article 9 (Changes to Terms of Service)

We may change these Terms without requiring individual consent from Users.
When changing these Terms, we will notify or announce the effective date and content of the revised Terms of Service by appropriate methods.
The revised Terms of Service shall take effect from the time they are posted on this website, except when we determine otherwise.

# Article 10 (Handling of Personal Information)

We will handle personal information obtained through the use of the App appropriately in accordance with our "Privacy Policy."

# Article 11 (Notices or Communications)

Notices or communications between Users and us shall be made by methods determined by us.

# Article 12 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer to third parties or use as collateral their position under the usage contract or rights or obligations under these Terms without our prior written consent.

# Article 13 (Governing Law and Jurisdiction)

These Terms shall be governed by Japanese law.
In case of disputes arising in relation to the App, the Tokyo District Court shall be the exclusive court of jurisdiction for the first instance.
